
Lead in Drinking Water?

What is Lead Testing?
The NYS Education Department (NYSED) requires all schools to test for lead in their drinking water using ELAP-certified laboratories, following regulations updated in December 2022 by Public Health Law §1110 and NYCRR Subpart 67-4. Testing must occur every three years, with samples collected from cold-water outlets after an 8-18 hour stagnation period. If tests exceed the 5 parts per billion (ppb) action level, outlets must be taken out of service for drinking/cooking, alternate water provided, and a remediation plan implemented. Results must be posted publicly on the school's website.
NYS DOE Requirements for Lead Testing
1. ELAP Certification:
All samples must be analyzed by a laboratory certified by the NYS Department of Health's Environmental Laboratory Approval Program (ELAP).
2. Sampling Schedule:
Schools must conduct triennial (every 3-year) testing of all potable water sources.
3. Sampling Method:
Collect samples from cold-water outlets that have been unused for 8 to 18 hours (known as "first draw" samples).
Use 250 mL plastic containers.
Use a laboratory-provided chain-of-custody form and label the sample bottle.
